ClimaAlert Terms of Service

These terms govern your use of the ClimaAlert mobile app and its supporting weather, environmental-risk, notification and community reporting services. ClimaAlert is operated by UB AI Systems, LLC. Contact: info@ubaisystems.com.

By using ClimaAlert, you agree to these terms. If you do not agree, please stop using the service. If applicable law requires a parent or guardian's consent for your use, obtain that consent before using the service.

1. Weather information and safe use

Weather observations, forecasts, risk levels, maps and AI-assisted explanations can be incomplete, delayed or incorrect. Forecasts and risk levels are estimates and may change as new information arrives. Community Reports are user-submitted observations and remain unverified unless clearly stated otherwise; they do not determine official risk severity.

ClimaAlert does not guarantee that every hazard will be detected, that a forecast will occur, or that a notification will reach your device. Notification delivery depends on permissions, your monitored location, connectivity, device settings, operating-system restrictions and service availability. Use official weather and emergency information and your own assessment of local conditions alongside the app.

2. Access and device settings

You may use ClimaAlert for lawful purposes in accordance with these terms. Features may depend on your app version, location, permissions and the availability of third-party services. Keep your device and app reasonably secure and review the location shown before relying on or sharing information.

You control location, notification, camera and microphone permissions through the app and your device settings. Some optional features cannot work without the relevant permission. Stopping use or uninstalling the app does not automatically delete server records; the Privacy Policy explains how to request deletion.

3. Community Reports and acceptable use

When contributing a report, description, photo, video or local observation, provide information that is accurate to the best of your knowledge. Only submit material you created or have the right to share, and obtain any permissions required by law. Capture evidence only when it is safe and lawful to do so.

You must not submit or use the service to distribute:

• Deliberately false or misleading hazard reports, fabricated evidence, spam or impersonation.
• Harassment, threats, hateful content, graphic violence, sexually explicit content, or any content involving child sexual exploitation or abuse.
• Other people's private information, identifiable images or recordings without a lawful basis or required permission, or content that infringes intellectual-property or other rights.
• Unlawful content, malicious software, or attempts to disrupt the service, bypass access controls, manipulate reporting or gain unauthorized access to data.

In the current reporting flow, Community Reports that pass automated submission and content checks are published immediately as “Community Report / Unverified,” without prior administrator approval. These checks do not establish that a report is true or accurate. Some submissions may be held or rejected by automated checks. Photos and videos undergo separate processing and safety checks, so a report can appear before its attachments, and some attachments may remain unavailable pending review. Older app versions may use a private review flow.

You retain ownership of your submitted content. You grant UB AI Systems, LLC a non-exclusive permission to store, process, review and display that content as needed to provide and moderate ClimaAlert, including making public reports available through the app, maps and report-sharing links, in accordance with your submission choices and the Privacy Policy. This permission does not transfer ownership of your content.

Publishing precise incident coordinates requires your separate, explicit consent in the report form. If you give this consent, the selected incident coordinates are made public without deliberate rounding to a coarse area. The incident pin may use your device's location or a point you select on the map, and may therefore match your capture location. This is the submitted position, not a guarantee of the incident's true physical location: device GPS can have measurement error, and a manually placed pin has no independently verified positional accuracy. Available GPS accuracy information may also be displayed.

If you do not give that separate consent, precise incident coordinates are not published as the report's location; a displayed location is an approximate area centre, or the location is hidden. An approximate area marker does not identify the exact incident point. Review the pin, description and media before submitting. Public photos, videos or descriptions can themselves reveal places or other personal information.

Reports may be reviewed after publication and restricted or removed when necessary. We may also reject contributions or restrict misuse of reporting features to enforce these rules, protect users or comply with law. Publication as Unverified is not verification, a promise of a response or emergency assistance. To report harmful content or question a moderation decision, use the report-a-concern control where available or email info@ubaisystems.com, including the report link or identifier and your concern.

4. Privacy and sharing

The ClimaAlert Privacy Policy explains the information we process, your permission choices, retention and data-deletion requests. Review the displayed location, report content and attachments before using a sharing feature. Other people and services may retain copies or link previews after sharing, even if the original report later becomes unavailable.

5. Service content and third-party services

The app, its branding and service content are protected by applicable intellectual-property laws. These terms allow you to use the service and its provided sharing features; they do not transfer ownership of the app or third-party materials. Respect source attributions and applicable rights. Third-party websites, maps, app stores and services may have their own terms and privacy policies.

6. Charges

The current ClimaAlert consumer app has no in-app purchase or advertising functionality. Your mobile or internet provider may charge for data use. Any future paid feature will have its price and applicable payment terms disclosed before you choose to purchase it.

7. Changes and ending use

We may update, suspend or discontinue features for maintenance, security, legal requirements or service improvements. Where required by law, we will give appropriate notice. You can stop using ClimaAlert at any time. To request deletion of associated data, follow the process in the Privacy Policy.

We may update these terms and their effective date. We will provide notice of material changes and obtain any agreement required by applicable law. Changes do not remove rights you have under applicable law.

8. Your legal rights

Nothing in these terms excludes or limits consumer rights, statutory guarantees, remedies or liability that cannot lawfully be excluded or limited. If you have a concern about the service, contact us so we can review it. You retain any right to seek assistance from a relevant consumer-protection authority or court under applicable law.
